General Terms and Conditions
1. Scope of application
These General Terms and Conditions (GTC) apply to all contracts between
Lukas Seidl, sports scientist & personal trainer (hereinafter referred to as “Provider”) and his customers (hereinafter referred to as “Customer”) regarding the use of the services offered on the website [https://lukasseidl-pt.com].
2. Subject matter of the contract
The Provider provides services in the area of individual training planning and personal support within the framework of a subscription model.
3. Conclusion of contract
(1) By placing an order on the website, the Customer submits a binding offer to conclude a contract.
(2) The contract is concluded as soon as the Provider confirms the order by email or the service clearly begins.
4. Scope of services
(1) As part of the subscription, the customer receives an individual training plan and ongoing support (e.g., via email or messenger).
(2) The exact scope of services is specified in the respective service description on the website.
(3) Adjustments to the plan are made in consultation with the customer.
5. Prices and payment
(1) All prices are quoted in euros and include sales tax, where required by law.
(2) Payment shall be made by direct debit at the beginning of each month.
6. Contract term and termination
(1) The subscription is concluded for an indefinite period.
(2) Termination is possible at any time without notice.
(3) Contributions already paid will not be refunded unless the provider has not rendered the agreed service.
7. Right of withdrawal
(1) Consumers have the legal right to withdraw from the contract within 14 days without giving reasons.
(2) The withdrawal period is 14 days from the date of conclusion of the contract.
(3) To exercise the right of withdrawal, the customer must inform the provider by means of a clear statement (e.g. by email).
8. Health & Liability
(1) The use of the training plans is at the customer's own risk.
(2) The customer is obliged to undergo a medical examination before starting training and to ensure that there are no health concerns.
(3) The provider accepts no liability for injuries, damage to health, or other disadvantages resulting from improper or unauthorized execution of the training plans.
(4) The provider's liability for slight negligence is excluded, provided that no damage to life, limb, or health is involved.
9. Place of jurisdiction & applicable law
(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) To the extent permitted by law, the competent court at the provider's place of residence shall have jurisdiction over all disputes.
10. Final provisions
Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
